Terms of Service

1. Who can use TomFiction

• You must be at least 13 years old and live in the United States.
• If you are under 18, you may use TomFiction only with the permission of a parent or legal guardian, who agrees to these terms on your behalf and is responsible for any purchase.
• A parent or guardian who buys a plan for a student agrees to these terms for themselves and the student.

2. What TomFiction does, and what it doesn't

• TomFiction's AI coach asks you questions, one at a time. Your essay is assembled only from your own answers. The service fixes spelling, punctuation and filler words, may add small connecting words, and marks every change in the Proof view. It does not write your ideas or sentences.
• The coach is an AI, not a person, teacher, counselor or therapist.
• TomFiction gives you an authorship record that shows which of your answers each sentence came from. It is a record of how the essay was made. It is not a certification of authorship, and no one is required to accept it.

3. Academic integrity is your responsibility

• You are responsible for following the rules of every school, teacher, scholarship and application platform you submit to, including the Common App's policies on AI-generated content.
• Some colleges and teachers restrict any use of AI tools, including for brainstorming, organizing or editing. Check their policy before using TomFiction for that essay, and don't use it where it isn't allowed.
• Read your essay before you submit it and make sure it is accurate and says what you mean.
• We make no promise about how any AI-detection tool will score your essay.

4. No promises about outcomes

TomFiction does not guarantee any grade, admission decision, scholarship or other result.

5. Sensitive topics and safety

Essays sometimes touch on difficult experiences. If you mention that you or someone else may be in danger, the coach pauses the interview and shows crisis resources. TomFiction is not an emergency or counseling service. If you are in crisis, call or text 988 (Suicide and Crisis Lifeline) or call 911.

6. Your content

• You own your words: your answers, recordings and essays.
• You give us a limited permission to process your content only to provide TomFiction to you (for example, sending your answers to our AI provider to run the interview), and, only if you turn on answer sharing, to use shared answers to improve the service. You can turn sharing off at any time.
• Your essays and answers are stored on your device. Keep copies of anything you want to keep; clearing your browser's data deletes them.

7. Acceptable use

You agree not to:

• use TomFiction to produce essays you will present as someone else's work, or on someone else's behalf;
• enter content that is unlawful or that infringes someone else's rights;
• get around usage limits, payment, the age check or security measures;
• scrape, overload, reverse engineer or resell the service, or access it with automated tools;
• use TomFiction to harass or harm anyone.

We may limit, suspend or end access for anyone who breaks these rules.

8. Plans, payments and refunds

• First essay free. Your first complete essay costs nothing.
• Single Essay: $12. Covers one more essay of any type, including revisions of that essay.
• Application Season Pass: $79, or the founding price of $49 for purchases made by November 30, 2026 at 11:59 pm Pacific time. The founding price ends then and doesn't come back. The pass covers essays of every type for 12 months from the purchase date.
• Fee-waiver students. Students who qualify for a college application fee waiver can ask for a free Season Pass at support@tomfiction.com. We reply with a code to use at checkout.
• Payments are processed by Stripe. Prices are in US dollars; any tax is shown at checkout before you pay. A parent or anyone else can pay for a student's plan with a link the student sends them.
• One-time purchases. Nothing renews or charges you again automatically.
• Refunds: a full refund within 7 days of purchase, no questions asked. See the Refund Policy.
• Your plan lives in this browser. To use it on another device, restore it with the email you bought it with.

9. Availability and changes

We may change, pause or discontinue features. We will tell you about significant changes to paid features, and if we discontinue a paid plan before its term ends, we will refund the unused part.

10. Disclaimers

TomFiction is provided "as is" and "as available". To the extent the law allows, we disclaim implied warranties, including fitness for a particular purpose. AI output (the coach's questions and reviews) can be wrong; use your own judgment.

11. Limitation of liability

To the extent the law allows, our total liability for any claim relating to TomFiction is limited to the amount you paid us in the 12 months before the claim, or $50 if you paid nothing, and we are not liable for indirect or consequential damages. Nothing in these terms limits rights you have under consumer protection law that can't be waived.

12. Disputes and governing law

Please contact us first at support@tomfiction.com; most problems are solved quickly that way. These terms are governed by the laws of the state where TomFiction is based and of the United States, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts there, unless the law where you live gives you the right to bring a claim locally.

13. Changes to these terms

We may update these terms. The date at the top changes when we do, and for significant changes we will tell you in the app before they take effect. Continuing to use TomFiction after that means you accept the new terms. Plans you already bought keep the price and length you bought them with.
